1 – ABOUT US

AFTERHOURS is the trading name of two companies. The company you buy from depends on your delivery address:

UK, EU and all countries outside the United States: After Hours Apparel Ltd, Lynton House, 7–12 Tavistock Square, London, WC1H 9LT, United Kingdom.

United States: After Hours USA LLC, 10085 North 78th Street, Scottsdale, AZ 85258, United States.

In these terms, “we”, “us” and “our” mean the company you buy from. You can contact us at contact@afterhrs.com.

These terms apply to your use of afterhrs.com and to every order you place with us. Please read them before ordering. Our store is hosted on Shopify.

2 – USING OUR SITE

You must be at least 18 to place an order. You agree not to use our site for any unlawful purpose, to copy or reuse our content without permission, or to interfere with the site’s security or operation.

3 – YOUR ORDER

After you place an order, we will email you to confirm we have received it. Our contract with you is formed when we email you to confirm your order has been dispatched.

We may refuse or cancel an order, for example if an item is out of stock, if there is an error in the price or description, or if we suspect fraud. If we cancel your order after you have paid, we will refund you in full.

4 – PRICES AND PAYMENT

Prices are shown in GBP or your local currency and include taxes and import duties. Delivery charges are shown at checkout and on our Shipping & Delivery page.

We try to make sure all prices are correct. If we find an error after you have ordered, we will contact you and you can either confirm the order at the correct price or cancel it for a full refund.

5 – DELIVERY

Delivery times and costs are set out on our Shipping & Delivery page. Your order is your responsibility once it has been delivered to the address you gave us, or to a neighbour or safe place you chose.

6 – RETURNS AND YOUR RIGHT TO CANCEL

Our returns policy, including your legal right to cancel within 14 days, is set out on our Returns & Refunds page.

7 – FAULTY ITEMS

We are legally required to supply products that are as described, of satisfactory quality and fit for purpose. If an item is faulty, please contact us and we will arrange a replacement or refund. Nothing in these terms affects your legal rights.

8 – PRODUCT INFORMATION

We make every effort to show our products accurately. Colours may appear slightly different depending on your screen, and measurements are approximate. Please check the size guide and product details before ordering.

9 – CLEARPAY

In the UK, you can pay with Clearpay, provided by Clearpay Finance Limited (company number 05198026), 101 New Cavendish Street, London, W1W 6XH. Clearpay lends you a fixed amount of credit so you can pay for your purchase in 4 interest-free instalments, due every 2 weeks. Payment is made to Clearpay, not to us.

You must be 18 or over and a permanent UK resident (excluding the Channel Islands). Clearpay credit is subject to status, and Clearpay’s terms and other eligibility criteria apply. Please make sure you can make repayments on time. Clearpay charges a £6 late fee for each late instalment and a further £6 if it is still unpaid 7 days later. Late fees are capped at £6 for orders under £24, and at the lower of £24 or 25% of the order value for orders of £24 or more. Missed payments may affect your ability to use Clearpay in future, and unpaid debts may be passed to a debt collection agency.

Clearpay Finance Limited is deemed authorised and regulated by the Financial Conduct Authority under the Temporary Permissions Regime for Regulated Deferred Payment Credit.

10 – INTELLECTUAL PROPERTY

All content on this site, including images, text, logos and designs, belongs to AFTERHOURS or our licensors. You may not copy, reproduce or use it without our written permission.

11 – OUR LIABILITY

We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We are not responsible for loss or damage that is not foreseeable, or for business losses. We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for breach of your legal rights as a consumer.

12 – PERSONAL INFORMATION

We use your personal data as described in our Privacy Policy.

13 – EVENTS OUTSIDE OUR CONTROL

We are not responsible for delays or failures caused by events outside our reasonable control, such as courier disruption, strikes or extreme weather. If this happens, we will let you know and do what we can to reduce the delay.

14 – CHANGES TO THESE TERMS

We may update these terms from time to time. The terms that apply to your order are the ones shown on this page when you placed it.

15 – GOVERNING LAW

If you buy from After Hours Apparel Ltd, these terms are governed by the laws of England and Wales. If you buy from After Hours USA LLC, these terms are governed by the laws of the State of Arizona, United States. If you are a consumer, you also keep the protection of any mandatory laws of the country where you live, and you can bring legal proceedings in the courts of that country.
